1. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. By using BrainUp, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Description of the Service
BrainUp provides tools for resume creation, document editing, productivity, and AI-assisted content generation.
BrainUp is not an employer, recruiter, staffing agency, or career placement service. We do not guarantee interviews, job offers, employment, income, or career outcomes.
3. No Professional Advice
All content provided through the Service, including AI-generated content, is for informational purposes only and does not constitute legal, financial, employment, or professional advice.
4. User Accounts & Data Storage
You may use certain features without creating an account. In such cases, your data may be stored locally in your browser and may be lost if you clear your browser data or change devices.
Creating an account enables additional features such as cloud storage, resume versions, and paid functionality.
5. User Responsibilities
- You are solely responsible for all content you upload or generate
- You confirm that you own or have rights to all submitted content
- You will not upload unlawful, harmful, misleading, or infringing material
- You will not attempt to scrape, reverse engineer, exploit, or disrupt the Service
6. AI-Generated Content Disclaimer
Use of AI features is entirely at your own risk.
7. Free & Paid Services
BrainUp offers both free and paid features. Paid features may be offered via subscriptions or one-time purchases.
Billing & Renewals
- Subscriptions automatically renew unless canceled
- You authorize us or our payment partners to charge your payment method
- Prices may change with prior notice
Refunds
Except where required by law, all payments are non-refundable.
8. Intellectual Property
All software, code, designs, trademarks, branding, and platform features are owned by BrainUp or its licensors.
You retain ownership of your content. By using the Service, you grant BrainUp a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely to operate the Service.
9. Third-Party Services
The Service may integrate third-party tools, APIs, or services. We are not responsible for third-party content, availability, or practices.
10. Suspension & Termination
We may suspend or terminate your access at any time, with or without notice, for violation of these Terms, legal requirements, or operational reasons.
11. No Warranties
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
12. Limitation of Liability
To the maximum extent permitted by law, BrainUp shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, income, or career opportunities.
Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless BrainUp from any claims arising from your use of the Service or violation of these Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Disputes shall be resolved through binding arbitration or courts located in India, as permitted by law.
15. Changes to Terms
We may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.
